초고령화사회 대비 관련 3법 분석을 통한 한국 의원입법의 특성

Abstract

최근 들어 한국사회의 민주화 정도가 높아지면서, 국회의원들의 의원입법 발의 역시 매우 활발해지고 있다. 그러나 상당한 의원입법이 사장되는 현실에 있어 많은 문제점 및 개선책이 제기되고 있었으나, 현실은 크게 나아지지 않은 것이 사실이다. 이에 본 연구는 한국사회가 당면한 주요 정책이슈인 제19대 및 20대 국회 발의 초고령사회 대비 3법의 모든 의원입법 발의안을 대상으로 실증분석을 통한 심층적 문제점 제시 및 함의를 제시하고자 한다. 본 연구는 기존연구에서 제시한 입법안의 세 가지 조건-민주성, 전문성, 효율성- 중 전문성과 효율성에 초점을 맞추어 실증분석을 실시하였다. 특히 입법안의 효율성을 체계적으로 분석하기 위하여 세 가지 정책이론을 통합하여 내용분석을 위한 분석틀을 제시하였다. 분석결과, 기존연구에서 논의한 바와 같이 임기만료폐기된 법률미반영안이 매우 높은 수준으로 나타났다. 둘째, 전문성의 측면에서 비용추계서도 없고 미첨부사유서도 첨부하지 않은 경우가 매우 높은 것으로 나타나, 전문성의 문제가 심각한 것이 재확인되었다. 셋째, 내용분석 결과 진보/보수 간 핵심정책신념의 차이에도 불구하고 상호 동일/유사 발의안이 상당하였다는 측면에서 상당히 비효율적 입법발의가 있었음이 확인되었다. 또한, 철학적/가치적 측면에서의 거시적 정책목표와 상관없이 정치적 합의가 수월한 정책수단 내지 수단셋팅 수준에서의 개정안 발의건수가 급증한 것으로 나타났다는 측면에서 정책설계 정합성이 상당히 낮은 발의안이 많다는 것 역시 밝혀졌다. 향후 한국의 의원입법이 나아가야 될 방향으로, 철학적/가치적 지향성에 기반하여 정책목표의 수립이 되어야 될 것이며, 이와 정합성을 가지는 정책수단 및 수단셋팅으로 구성되는 정책설계가 반영되는 입법안이 되어야 될 것이다. 또한, 실제 실현가능성의 측면에서 재정적 전문성이 담보된 입법안의 필요성이 다시 한 번 강조된다고 할 수 있다.

In recent years, as the degree of democratization in Korean society has increased, members of the National Assembly are also very active in their law-making initiatives. However, most of the propositions are discarded without being discussed resulting ineffective legislative activities. Therefore, this study intends to suggest policy implications through empirical analysis targeting all the legislative bills of the 3 Acts for the super-aging society initiated by the 19th and 20th National Assembly. This study conducted an empirical analysis focusing on professionalism and efficiency among the three conditions-democracy, professionalism, and efficiency-of the legislative proposals suggested in previous studies. In particular, in order to systematically analyze the effectiveness of legislation, three policy theories were integrated to present an analysis framework for content analysis. As a result of the analysis, it was confirmed that there were quite inefficient legislative proposals in that the number of mutually identical and similar proposals was considerable. In addition, regardless of the macro-policy goals in terms of philosophical values between progressives and conservatives, the number of proposals for amendments at the level of policy means or means setting was found to have increased rapidly. Even though these proposals are easy to on political agreement, these proposals were not processed. For the effective legislative activities in the future, the direction of the parliamentary legislation should be established based on the philosophical/value orientation, and it should be a legislative bill reflecting the policy design consisting of policy means and means setting. Also, the policy consultation function within the political party should be activated
